The Business Ombudsman completes first complaint investigation, sends the first response act to the state body

On April 28, 2020, by the Regulation on the authorized person to protect the rights, freedoms and legitimate interests of business entities (Business Ombudsman), approved by Decree No. 647 of the Government of the Kyrgyz Republic from December 31, 2018, the Business Ombudsman, Robin Ord-Smith has sent the first recommendation to the state authority of the Kyrgyz Republic. 
 The decision was prepared as a result of a complaint investigation filed by the business entity to the Business Ombudsman against the decision of the state body of the Kyrgyz Republic based on the check conducted. In the course of the process, a dispute arose on the issue of legal interpretation and enforcement of the law of the Kyrgyz Republic. To facilitate the resolution of this dispute, a comprehensive analysis of all information received from both parties was conducted following the principles of the rule of law, impartiality, independence, and fairness. Following this, the Business Ombudsman substantiated the complaint of the business entity that its rights, freedoms, and legal interests had been violated. The recommendation includes a summary of the complaint, the reasons, and facts on which the decision has been taken. It includes recommendations to eliminate the violations of the rights and legitimate interests of the business organization identified and to prevent their recurrence. Up to the date, the Business Ombudsman has received 22 complaints from entrepreneurs and business representatives. The Institute of Business Ombudsman continues to provide advice and receive complaints from businesses against actions or decisions of government bodies, local self-government, and public sector enterprises through www.boi.kg website.
